Both queries¹ can be answered in the negative subject to one qualification. The condition of precedent for action under Article 28.3.3^o is the taking place of an armed conflict. Once there is an armed conflict, resolutions of the Houses of the Oireachtas to the effect set out in the Article are conclusive and not capable of review.
